I ROBERT ROSE of Washinton Township Harrison County in the State of Ohio being weak in body ocasioned by old age, and infirmaty, but of sound mind memory and under- standing, considering the certainty of Death and uncertainty of the time thereof, and being desirous to settle my worldly affairs, and thereby be the better prepared to leave this world when it shall please God to call me home, do therefore make and publish this my last will and testament in manner and form following, that is to say -- First and principally I commit my Soul into the hands of Almighty God who gave it, and my body to the earth to be decently interred at the discretion of my Executor hereinafter named, and after my debts and funeral expenses are paid I devise and bequeath as follows: I devise and bequeath as follows: - Item first I give and devise unto my beloved wife all my personal property, and also so much of the proceeds of my real property as may be necessary for her maintenance during her natural lifetime; after the death of myself and wife, I devise and bequeath unto my son AMOS ROSE that tract of land on which I now live, it being the West half of the North West quarter of sec't five, in Township twelve, of Range seven, in the Steubenville land District and to his heirs and assigns forever it being all I possess. - Item second, and whereas my sons HUGH ROSE & HENRY ROSE, and my Daughters SUSANNAH ROSE, alias SUSANNAH STRAHAN, and MARTHA ROSE, alias MARTHA STEPHENS have not acted the part of sons and daughters to me, I do there- fore declare that the sum of one dollar shall go in full of all right title, interest, claim, and demand whatsoever, which they may or can have, or pretend to have, or claim of in or to all or any part of my real or personal estate; - Item third, I further direct and require my Executor herein named, to sell, after the death of myself and wife, all my personal property that remains unexpended and appropriate the proceeds thereof as follows Viz: First pay my funeral expenses, Second pay each one of the above named heirs the sum of one dollar as above directed and then divide the remainder equally between my sons JACOB, JAMES, GARDNER, and JOHN ROSE, and my Daughters MARY ROSE, alias MARY VANHORN, and NANCY ROSE, alias NANCY AN**** which dividend shall be their full shares of all I possess. And Lastly I do hereby constitute and appoint AMOS ROSE of Washington Township to be my sole Executor of of this my last Will and Testament, revoking and annulling all former wills by me heretofore made, ratifying and confirming this and none other to be my last will and Testa- ment - In testimony whereof I ROBERT ROSE, here to this my last will consisting of one leaf of paper, set my hand and seal this sixteenth day of March in the year of our Lord eighteen hundred and forty. This day a paper writing purporting to be the last will and Testament of ROBERT ROSE Deceased was brought into court, and the same being exhibited to WILLIAM GRIFFITH, one of the subscribing witnesses thereto, and the said WILLIAM GRIFFITH being first duly sworn, he did depose and say that he saw the said paper writing signed by the said ROBERT ROSE in his lifetime as and for his last will and Testament that he the said deponent signed the same as a witness in the prescense and at the request of the said ROBERT ROSE, that he the said ROBERT ROSE, was at the time of signing the said paper writ- ing, of sound & disposing mind and memory, that he was more than twenty one years of age, & that he was under no restraint. And JOHN AULD another subscribing witness to said paper writing being also duly sworn, and the same exhibited to him he did depose and say that he saw the said paper writing signed by the said ROBERT ROSE in his lifetime and as for his last will and Testament that he the said deponent signed the same as a witness (last two words are too dark to read.) ==========================================================================
