TALBOTT deceased. Be it remembered that on the 13th day of August 1873, there was filed in the office of the Judge of the Probate Court of Crawford County, Ohio, a certain will of JOHN R. TALBOTT, deceased, in the words and figures following to wit: "In the name of the Benevolent Father of all;" I JOHN R. TALBOTT of Jackson Township Crawford County, Ohio, do make and publish this my last will and testament. "Item 1st I give and devise to my beloved wife SUSANNA W. TALBOTT in lieu of her dower my house and lot in Crestline, and described as lot Number Sixty-five (65) in Livinston's Second Addition to the town of Livingston now part of the Incorporated village of Crestline, Crawford County, Ohio, to have and to hold said premises for and during her natural life and from and after her death I give and devise said premises to my son JOHN M. TALBOTT and my daughter SARAH G. TALBOTT and their heirs forever. Item 2nd, I give and bequeath to my son JOHN M. TALBOTT and my daughter SARAH G. TALBOTT all my Government Bonds, that I now have on deposit at the bank of Babst Martin & Co., Crestline, Ohio, when they become of legal age, respectively, to share and share alike, and upon the decease of either of my children aforesaid, then the survivor shall take the whole of said sum of bonds, and should they both die then I give said bonds to my Brothers and Sisters share and share alike. Item 3rd I give and bequeath to my wife SUSANNAH W. TALBOTT, so long as she remains my widow, but in no event for a longer time than until my children shall become of lawful age, the interest that has accrued, and that may hereafter accrue on the Government Bonds herein given to my children JOHN M. and SARAH G. TALBOTT, until they the said JOHN M. and SARAH G. TALBOTT shall arrive at legal age, and I desire order and direct my Executor to deliver to my said children their respective shares when they shall become of legal age, re- spectively. In the event that my widow should intermarry then the interest aforesaid shall be given to my said children. Item 4th I give and bequeath absolutely, to my wife SUSANNAH W. TALBOTT all the rest residue and remainder of my personal Estate except such has herein been specially given and bequeathed upon the trust following to wit that she pay out of her seperate effects all my funeral expenses and all my just debts. Item 5 I do hereby nominate and appoint my wife SUSANNAH W. TALBOTT, Executor of this my last will and testament, with full power to fully settle and adjust my estate in every respect. Item 6th I desire that no appraisement and no sale of my personal property be made, and that the court of Probate direct the omission of the same in pursuance of the Statute. I do hereby revoke all former wills by me made. In testimony whereof I have hereunto set my hand and seal this 3 day of February A.D. 1873. JOHN R. And afterwards the following testimony was filed herein to wit: The State of Ohio, Crawford County We, JOSEPH J. TALBOTT and DANIEL BABST, JR., being duly sworn in open court this 13th day of August A.D. 1873, depose and say that we were present at the execution of the last will and testa- ment of JOHN R. TALBOTT hereunto annexed; that we saw the said testator subscribe said will and heard him publish and declare the same to be his last will and testament and that the said testator at the time of executing the same was of full age and of sound mind and memory and not under any restraint, and that we signed the same as witnesses at his request and in his pre- sence, and in the presence of each other. DANIEL BABST, JR JOSEPH J. TALBOTT Sworn to and subscribed before me in open court this 13th day of August A.D. 1873. ROBERT LEE, Probate Judge And afterwards the following order of court was made herein to wit: In the matter of the last will {In Probate Court testament of JOHN R. TALBOTT deceased {August 15th 1873} The last will and testament of JOHN R. TALBOTT late of Crawford County, Ohio, deceased, was this day produced in open court and DANIEL BABST, JR., and JOSEPH J. TALBOTT, the subscribing witnesses to said will appeared, and in open court on oath testified to the due execution of said will, which testimony was reduced to writing and by them respectively subscribed and filed with said will, and it appearing to the court by said testimony that said will was duly attested and executed, and that the said testator at the time of executing the same was of full age and sound mind and memory and not under any restraint, It is ordered by the court that said will and testimony be recorded.
